The Snake or God?

I don't believe in creationism, and you don't either to answer this question. But in the story of Genesis, why was God being so restrictive about the Tree of knowledge and then inflict curses on us, when we decided to think independently? Is that not an evil God restricting us of that knowledge? And why the heck did he put a talking snake in the Garden and not see this one coming?
